阿九卻迫不及待要解放台灣的軍隊

第二、 不打團體戰、只突顯個人人格特質好不好?
馬英九是政治明星,是政治藝人,你要和他比個人人格特質,包括我在內,必輸無疑。一般藝人明星鬧什麼誹聞,或做錯什麼,對長期粉絲是沒有什麼影響的,選總統不比中央執政,去比地方市政就很奇怪,除非綠卡可以致命一擊,打了兩個月,歹戲拖棚,大家也見怪不怪了。民進黨立委基本盤是40%,總統基本盤應該有 45%,選戰策略在45%與5%的選擇,我主張鞏固凝聚45%,就有另外的5%,是45%的基本盤幫我們去拉另外的5%,自然過半。謝總部則認為這45% 基本盤是固定的、固有的,不必努力爭取,最後「三國歸一統」,票都在。仍缺另外的5%,為了這5%,必須拉許信良,施明德,陳耀昌、李登輝等勢力,結果 5%沒拉到,45%變成41%。

第三、 放棄入聯公投的訴求,聰明不聰明?
台灣的選舉跟別的國家不同的是,中國因素佔了很大的比重。1996年總統大選,中國對台試射飛彈引起台灣人的反感,李登輝壓倒性的勝利。2000年政黨輪替,與中國朱鎔基總理在選前的文攻武嚇不無關係。2004年連任成功,防衛性公投的舉行,「歷史上的第一次,全世界都在看」,公投成為選戰主軸是一大原因。國民黨以返聯公投反制入聯公投,足見入聯公投的厲害與重要。有人在美中聯手打壓下怕了,退縮了,甚至認為入聯公投是票房毒藥,造成最後的70天,入聯公投的台灣牌不見了,只剩下綠卡,終於卡住綠營的綠色執政。

力爭上游是人類的本能,在力爭上游的過程中,難免也有人性的弱點,不易超越。沒有人不想成功,識時務為俊傑,爭大的就有讓小的,小不忍亂大謀,想太多未必是好事,太聰明反受聰明誤,我的成功經驗,我的失敗教訓,就如同一面鏡子,使我看清自己的不足和有限。從囚房的小洞看出去,牆上的一句話似乎是特別寫給我惕勵自省的──不能低頭的人是因為一再回顧過去的成就。

好不容易有阿扁的軍隊國家化,但是阿九卻迫不及待要解放台灣的軍隊。

中國共產黨有人民解放軍,中國國民黨有國民革命軍。人民解放軍不屬於中國人民,屬於中國共產黨;國民革命軍不屬於全體國民,屬於中國國民黨。解放軍也好,革命軍也罷,都是黨軍,都不是國家的軍隊、人民的軍隊。在中國,解放軍服從共產黨的絕對領導與指揮;在台灣,以黨領政,以黨領軍,革命軍效忠國民黨一黨,效忠革命軍之父一人。在中國,軍隊國家化是不存在的字眼;在台灣,軍隊國家化只是憲法的條文,從未落實過。

憲法第137條第2項規定,國防之組織,以法律定之。這是軍事憲法的法源依據,2000年1月方有史上第一部《國防法》的立法公佈,易言之,行憲半個世紀以上,沒有《國防法》的母法,只有《國防部組織法》、《參謀本部組織法》的子法,沒有媽媽,卻有孩子。尤其國防部長與參謀總長誰比較大,所謂軍政、軍令究竟是一元化、抑是二元化,長期以來一直是敏感的問題。參謀總長在《國防法》未完成立法之前,是不受國會節制的,立法院要總長負責備詢,總長一句「他在軍令系統是總統的幕僚長」,你也拿他沒有辦法。我們引據總長在軍政系統同時也是部長的幕僚長,總長完全不予理會,總長權力最大,遠遠超過部長。這也是為何我在立法院長期在國防委員會力主軍政軍令一元化,反對軍政軍令二元化,更反對軍政軍令個人化的緣由。

我在國防委員會提倡「國防四大改造」:一、軍隊國家化,二、軍政軍令一元化,三、情治單位法制化,四、軍品採購公開化。並爭取出任國防委員會召集委員的職務,在軍系立委強力杯葛下,付出院會移送法辦的代價。不過國安會、國安局逐步法制化,毋寧是令人欣慰之事。

為了《國防法》之立法,我提出國防組織法草案,連續兩年,跨會期、跨年度,希望院會能同意付委審查,軍系立委一句「我反對」,每次都被擋下來。第21次提案才成功,但附帶條件必須等到行政院提出草案版本使一併審查。經過將近10年的等待與審議,2000年1月《國防法》終於完成立法。

除三軍政治中立之義務,明定在《國防法》第6條,貫徹現役軍人不得擔任政黨、政治團體或公職候選人提供之職務,或加入參與政黨、政治團體或公職候選人舉辦之活動,以及在軍中不得有黨的組織及活動。軍隊國家化不再是口號或憲法的條文,在我8年總統任內,我們真的做到了,我們深以為傲。我說過,只要軍隊國家化,現役軍人做到政治中立,不怕媒體亂,不怕國會亂,軍人維持政治中立,軍隊就不會亂,軍隊不亂,國家社會就亂不起來。

《國防法》第13條更明定,參謀本部是國防部長的軍令幕僚,參謀總長承部長之命令,負責軍令事項指揮軍隊。自此確立,軍政軍令一元化,部長大或總長大之爭議正式落幕。本來《國防法》自公佈後3年內實施,我提前一年在2002年,由參謀總長湯曜明出任《國防法》正式實施的首任部長,並在今年卸任總統職務前3 個月,真正做到沒有軍人背景的蔡明憲博士出任最具實權的文人部長,貫徹《國防法》第12條「文人領軍」的要求。

今年(2008)年初,情報顯示中國人民解放軍有可能攻佔我外島,擊沉我船艦,內部極為緊張,國防部長每個禮拜都主持應變會議,並有多套劇本因應。特別在 2008大選之前,我們換了文人部長,不但渡過大選期間的考驗,在政權和平移轉的2個月過程中,禁得起最嚴厲的挑戰。這一切的堅持成功,無非緣自於8年來我們落實軍隊國家化的信心。

阿九讓的越多,中國越看不起這個人,自古皆然,拜請阿九千萬不要再出賣台灣主權。

中國有意對台動武,這是眾所周知之事。前提不存在,「四不一沒有」的保證,說了等於沒有說,2000年中國對台部署200枚的彈道飛彈,2008年我卸任總統,已經增加到1,328枚。2002年,江澤民主席在十六大的政治報告不承諾放棄對台動武。2005年3月人大通過「反分裂國家法」,為武力犯台取得法源依據。2007年胡錦濤主席在內部會議宣示,解放軍的工作只有一項,就是對台作戰。何況中國對台動武三階段的任務準備,從未停止過,2007年以前完成全面應急作戰能力的準備;2010年以前完成大規模作戰能力的準備;2015年以前完成決戰決勝能力的準備。

有人以為台灣對中國讓步,中國一定會有善意的回應,是非常天真的幻想。中國不可能撤除或減少對台飛彈的部署,如同在一個中國原則下,中國不可能同意一中可以各表。中國反對一中一台,也反對兩個中國,所謂一中各表等於兩個中國,當然無法接受。對中國而言,九二共識等於一中共識,沒有一中各表的餘地,所謂和平解決等於和平統一,不可能讓台灣和平獨立。中國的一個中國原則與台灣問題的基調已定,不是中南海的那些人可以改變,只有2,300萬台灣人民才有權改變。

100%的言論自由,是台灣人執政才有的事,阿九馬上漸漸回到獨裁威權統治的狀態,看看中國小官陳雲林來台,就非常清楚。

請到網站看「台灣戒嚴」,有許多真實紀錄片,就會知道台灣人真福氣啦,阿九可是中國的國寶。

22年前,我為爭取100%言論自由,為爭取100%出版自由、新聞自由而坐牢,我對威權政府箝制新聞自由、打壓言論自由,有切膚之痛。我不希望歷史重演,再以影響國家安全、破壞政府與人民之間的感情為由,以行政權力來控制媒體、迫害媒體、打壓媒體,否則很容易又回到獨裁威權統治,這也是我的信念和信仰。

有人批評說,行政院及新聞局要關掉TBVS,為什麼我反對甚至阻擋,這是莫須有的指控。行政院謝院長在每週一次的例行會面中,曾提到要對電子媒體開刀,對象是東森,我還反問為何不是TBVS,院長說是根據新聞局統計,東森的違規紀錄比T台多,我沒有多講話,這也是東森第53台被停播一個月的緣由,害的當時主持53台政論性節目的黃越綏老師對我多次抱怨。

至於T台涉及港資、中資介入,引發是否違背廣電法令,應否撤照的爭議,新聞局與T台業者各有說詞,主要是法令適用及證據是否充分的問題,我未加以干涉。我反對T台批評政府或污衊總統被撤照,但如有任何違法,嚴重到必須處以撤照處分,我不會有意見。後來因為NCC國家傳播通訊委員會成立,新聞局對媒體的處分權移到NCC,國民黨控制的NCC,以獨立機構的立場不予處分,不論原因為何,均與總統無涉。

我容忍媒體之亂,不是沒有正面的代價,不論美國華府的自由之家或法國巴黎無疆界記者組織,在2007年都把台灣評鑑為最自由的國家之一,不僅言論自由 100%,新聞自由則是亞洲第一名,比日本的新聞自由還自由。我付出代價,我的家人付出代價,我的親友付出代價,我的黨付出代價,台灣從過去沒有新聞自由、沒有言論自由的國家,一躍而成為亞洲最自由的國家,可以媲美歐美先進國家,這是台灣人民的共同成就與驕傲。

老農福利津貼、消費券,比起18%真是小巫見大巫,只是鼻屎,台灣人要爭取人人18%,月月有消費券。

老農生活福利津貼一個月3,000元,是民進黨在野時爭取的,8年從未調整,我力主應檢討提高。一個月多1,000元,一年就要增加84億,雖無法和榮民津貼一個月13,500元相比,至少讓一輩子辛苦流汗的老農民感受政府的存在。在我任內老農津貼從一個月3,000元提高到4,000元、5,000元,到現在6,000元。很多老農民看到我或在民主電台call in節目頻頻稱謝,我不敢當,這是應該要做的事。目前景氣不好,有些老農民就是靠這筆津貼過活的。

把台灣或是ROC賣給中國,就一切搞定,阿扁8年來的努力,於阿九執政短短不到3個月,就破功。

美國國安會前資深主任李侃如教授,穿梭兩岸推銷「中程協議」,希望維持海峽兩岸30年、50年不變。剛開始還有前提結論,要台灣接受「一個中國」的前提、「終極統一」的結論,為我悍然拒絕。有了中國所設定的前提結論,還簽什麼?接受一中原則、同意終極統一,等於投降,中程協議變成投降協議,變成降書,誰願簽署、誰敢簽署?

後來李侃如又來台灣,這次他說沒有前提,沒有結論,無任何條件的中程協議,維持30年、50年不變。他先問我的意見,接著要到對岸去,我請他先問問北京中南海那些人的意見再說,之後就沒有下文了。

2005年2月27日、28日,美國柯林頓前總統應台灣民主基金會之邀,蒞台訪問並演講。我有兩次與他會晤的機會,相談甚歡。第一次在遠企大樓晚宴,第二次在228上午於台北賓館對談。李侃如教授是柯林頓總統主政時的國安會資深主任,負責亞太事務。有關中程協議的創見,他應該聽過並有他的高度看法。當我問到這個議題時,柯林頓總統毫不思索的說:台灣不能接受,對台灣沒有好處,時間站在台灣這邊,為什麼是30年,誰能夠保證。

1951年5月西藏地方政府和北京的中國中央政府簽署17條的和平協議。內容固有中央政府將保障西藏人民的自治及宗教信仰自由,並尊重達賴喇嘛、班禪喇嘛傳統地位,但西藏的軍隊必須編入解放軍,解放軍將進駐西藏維持秩序,至於外交,則交由中央政府擁有並行使。17條的和平條款,其前提仍須西藏地方政府接受一個中國原則,西藏是中國的一部分。很清楚的,和平協議的兩造,一方是中央,一方是地方,這就不對等。沒有軍隊、外交的自治,等於一國的內政,完全受中央宰制,無法自力自主。

姑不論洋洋灑灑17條,中國西藏和平協議只維持8年,和平成為騙人的口號,協議變成廢紙,17條剩下沒半條。1959年3月14日發生舉世震驚的西藏抗暴事件,根據統計死了8萬人,20萬人被關,10萬人隨著達賴喇嘛流亡印度,一去49年,班禪喇嘛被抓去北京。和平協議並未帶來真正和平,而是換來血腥屠殺的浩劫災難。

迎接馬總統 苗縣砸逾7千萬 2009/01/27

為了迎接馬總統的到來,苗栗縣政府砸大錢,在馬家庄大興土木,蓋停車場、拓寬馬路,還在花圃上修剪出駿馬奔騰的圖樣,政府擴大內需給苗栗的1億7千萬,馬家庄就用了7千多萬,縣長說這不是拍馬屁,是要拼觀光,而且才花了7千萬而已。

馬總統還沒到,縣長劉政鴻已經先一步來到馬家庄,檢視所有的細節流程,因為這可是他得意的傑作,一個半月的時間,馬家庄馬路變寬、變新了,停車場蓋好了,花圃裡不僅鋪上紅地毯,為了討馬總統歡心,特意修剪成駿馬的圖樣。

政府擴大內需給苗栗的1億7千萬,馬家庄就用了7千多萬,為了拼觀光,劉政鴻理直氣壯,但錢真的花在刀口上嗎?像一個舞台只為了馬總統不到10分鐘的談話,景氣這麼糟,這些錢這樣花,不知馬家庄以外的全國民眾會怎麼看!

Analysis of the Unificationists’ Mental Confusion

The way to build a nation on Taiwan requires full utilization of various tactics: attacks, counter-attacks, and counter-advancements. With president Chen Chui-Bien representing the Taiwanese sovereignty’s in the National Administration, the Taiwanese should master the Chinese Imperialists’ style of governance; in turn, applying such ruling method while governing the Chinese Imperialists. Ruling a country is like doing a small time cooking. With addition of spices, and without major changes, is capable of completing a full mountain of works while revealing the political ghosts’ and goblins’ conspiracies and thereby rendering all their plots unfeasible.


The Unificationists hunger for power, money, and influence can be practiced in Mainland China. Taiwan’s nation building demands principled sovereignty and security, active participation in the global economy and international markets, and well-established commercial trading with friendly nations. Such are the normal and proper developmental path of a country. The way I see it: The Chinese anti-business zealotry has already materialized. Since the ancient times, the Chinese Imperialist mentality has never, and will never, change easily. Demanding democracy, human rights, and rule of law is extremely difficult: “single-head politics” always wins. Even in Taiwan, such single-heads rule. The Chinese are also accustomed to the Chinese-killing-Chinese internecine, while disallow Taiwanese participation in politics. When facing the facts that Taiwanese people losing their lives under the “single-head” dictatorship, the Chinese don’t even bother to take such atrocities seriously. What many cannot tolerate are these China-indoctrinated “single-head” characters. In ancient China, the emperors called themselves kua jen (literally means “few, unique”)…truly surreal. Accordingly, the Chinese mafia at Taiwan becoming an evil force of anti-Taiwan, selling Taiwan and betraying Taiwan is not to be surprised. Their anti-democratic mentality has no purpose other than to continue and perpetuate their dreams of privileged rule. Such hysterical and rebellious behavior toward the Taiwanese self-governing also proves that the current generation of Chinese mafia and their pawns are infected with “Political Deposing Phobia Syndrome.”


To say that the Taiwanese people’s hypocritically home-loving mentality is the enslaving result of a lengthy period of education designed by the ruling filled with “grater China” propaganda, I rather say that the Unificationist education had, early on, tamed the Taiwanese people into submissiveness. The “greatness” of such educational propaganda is that once those being ruled are tamed into docile slaves and servants, they actually ended up knowing only to appreciate and return favor to the ruling power, without consideration of a normal human’s characters, fairness, and justices.


The awakened Taiwanese come from overseas: the lands without slaves and servitudes. To breakthrough the leveled and embedded symbiotic ruling system, in addition to relying on importing democratic ideology from overseas, we also need to rely on assistances from democratic nations like the US, Japan and the European countries. Even now that Chen Shui-Bien is elected as Taiwan’s national president, our country still needs to borrow a trashy shell, such as the Republic of China, to face the public. This shows that very many obstacles remain for the Taiwanese people to self rule.


The unificationist China party (aka KMT), for a long time, has always been afraid of US assistant to Taiwanese democracy. Because of foreign democratic states’ assistance, Taiwan is enabled to become a “green” land: only then can today’s politically “green” Chen Shui-Bien was given the opportunity to the administration. The unificationist China party becomes hostile against the US, against Japan, against this, against that, against everything; and parasitically manipulates democracy to destroy democracy. They not only loosely abandon the Republic of China’s communist fighting principle to flatter China, but also demand complete destruction of Taiwan. Hence, they become the evil forces that are against growth of democracy. The 23 million Taiwanese should be able to perceive such unificationists’ confusion phenomena. Therefore, we, the Taiwanese people must insist on our own path to democracy.


Psychoanalysis of this Chinese mafia reveals the following types of mental Defense Mechanism:


Does not trust the CCP regime yet allies with and depends on the Chinese communists to attack Taiwanese administration.
Has no interest in becoming a Chinese of Mainland China due to extreme lack of trust of the CCP regime.
Earnestly wants to become a citizen of the US, UK, Canada, Western European nations, Australia, and New Zealand yet expects Taiwanese people to surrender to China.
Perceives oneself as an aristocratic Chinese when among the Taiwanese, yet lowers oneself when facing the pure blood Chinese of Mainland China and afraid to compete against them.
Polarizes the Chinese in China by dividing them into the aristocratic ruling class and the lower class of poor, just like their fond separation of the rulers and rulees in Taiwan; all these originate from the feudal Chinese imperialist mentality.
The Unificationists are not interested in building and embettering Taiwan, but are only interested in grabbing and exploiting Taiwan’s ruling authority. Once money and power are obtained, they will leave.
Because they’ve been long in low self-esteem, the unificationists are prone to self-aggrandizements and behaviorally obsessed to suppress anything local and native.
The unificationists hold the narrow-minded mentality of “anything I failed to obtain, you shouldn’t think about obtaining.”
Uses the ROC flag to intimidate the Taiwanese people, but switches flags to surrender when facing CCP officials.
Expects the Taiwanese people to surrender to the CCP with the Unificationists, therefore openly calling out the slogan of “Anti-Military Purchase, Want Peace.”
Internationally calls out One China Principle, (this “one China” being PRC) while domestically also declares the so-called “One China Principle” with ROC as the one China to disguise their China-my-home belly.
In order to protect their obtained power and privileges, willingly sacrifices their children and grandchildren’s future at Taiwan to oppose the pro-Taiwan A-Bien’s administration.
Even now uses all means at disposal to conspire for a joint effort of KMT and Chinese communists until the Unificationists’ grand old hardliners succeed in political administration.


The Unificationists originated from the 1945 waterloo, and “CCP bandits” fearing engendered escaping through the sea to attack Taiwan. In the early years, the old Chiang calls out “Fight Back to Mainland China.” In the middle period there is the young China’s Three-No’s Principle. Due to the United States moving towards the “One China Principle,” KMT turns from prosperity to hollowness. And the Unificationists change from upholding Three Principles of the People for unifying China to today’s comprehensive surrender to the communists. Yet the democratization of Taiwan’s legal order and the repeal of criminal laws’ Article 100 actually supply the Unificationists’ carrying-democracy-to-destroy-democracy leeway for disturbance; and striking to the point of disabling a strong chap like A-Bien. As for now, they even coordinate in the fashion of “allying with communists to suppress Taiwan” and intensifying domestic ethnic conflicts by polarizing the groups; becoming an accomplice of the Chinese communists. Everyone please take a look: the behaviors of these unificationist law makers in the Legislative Yuan; aren’t they like a bunch of dancing demons?


Curing the Unificationists’ Mental Confusion Requires Medication: a Discussion


Pursue the truthful reality of Taiwan’s international status, and build Taiwan’s status within the framework of international laws.
Actively pursue and carry out civilian diplomacy and demand that the United States (as well as the rest of the world) understands Taiwan’s mainstream popular viewpoint.
Creating a new constitution and name rectification should be progressively proceeded; without paying attention to the Unificationists’ outcries.
Precisely diagnose the Unificationists’ mental confusion’s symptoms and eliminate their institutions’ positions in government; for Taiwan must require popular consensus in order to repel the communists, restrain the Unificationists, and save Taiwan.
Adroitly deploy street protests and activities to inspire popular resolve and support.


Taiwan’s Nation-Building also Needs Procedures


Eliminate the ROC constitution and create a new constitution for the Republic of Taiwan.
Eliminate the ROC totems, from the insides to outsides.
Acknowledge the existence of Taiwan’s independent sovereignty as the reality and proceed into the course of Taiwan’s nation-building.
The history of Taiwan’s international status needs to re-emerge; and hold all kinds of forums and verbal-outcry-on-street activities.
The political administration should draft up the strategies and procedures for nation-building, obtain the entire nation’s consensus, and invite the civilian activist groups to participate in the creation of the constitution.
The party in administration should initiate symposiums to discuss Taiwan’s constitution.
Establish a citizen’s lawmaking mechanism. The people of the Republic of Taiwan must proactively join forces to deal with the “allying with communists to suppress Taiwan” activities. The countering schemes can vary from civil to military, depending on the situation. The influence of the tertiary force among the civilians holds the key function.


Conclusion


The Unificationists had already fallen into the “allying with communists to suppress Taiwan,” which is effectively within the Chinese communists’ warfare sphere. They all are low in morale and guilt in conscience. Their show of enthusiastic, brave, and fierce behavior is only an illusion. The Taiwanese people should activate everyone to spread and communicate communist-resisting and nation-building ideologies. As long as the administration authority persevere, people will support at all costs.


According to the KMT-CCP meeting and the information purposely displayed by China’s governmental website, one can easily notice Chinese leaders hold some expectation regarding Ma Ying-Jeou and believes that Ma is likely to be elected as the next president. And once he is elected, a secret meeting between KMT and CCP will be the basis for a four-year layout: the first year, 2008, unconditional Three Direct Links will be declared. The second year will open up Taiwan for Chinese labors to replace non-Taiwanese foreign labors. The third year will open up to recognize PRC academic diplomas and certificates to accommodate unification in the future. The fourth year will establish a timetable for unification, gradually untie Taiwan’s military power, station PLA at Taiwan, and revert Taiwanese military to “home country” (namely PRC); so as to avoid after the enactment of one-country-two-systems, the Taiwanese military starts fighting the communists and a civil war breaks out.


ROC’s totems carry the colors of dictatorship and should have been eliminated long ago. However, though Taiwan has made strides toward democracy, in reality, it’s still pinned down by the China party. On the contrary, the China party can sit comfortably and command Taiwan to “turn red” and capriciously destroy ROC. Its end goal is to de-ROC and let PRC replaces it. This action is effectively an execution of striking its main enemy: the Republic of Taiwan’s nation building.


2008, the first year, the unconditional Three Direct Links will inundate Taiwan with illegal, jump-off-the-plane Chinese immigrants. Under Taiwan’s current non-linking situation, there are already an estimated 30 to 50 thousand illegal Chinese immigrants, which already materialized, under our visibility, into Taiwan-destroying and terrorism-prone “fifth military file.” In the second year, after opening up to approximately 200 thousand Chinese labors, Taiwan’s laborers in the traditional manufacturing industries and the part-timers will all lose their jobs. That’s the end of the entire blue collar sector. The third year opens up recognition of Chinese degrees and diplomas, then Taiwan’s white collar workers lost their role. The fourth year, with the timetable of unification, Taiwan fate will be sealed and surrender is certain. Taiwan’s 400 year history of striving will become an official history. And the rights and enjoyments of democracy and home country sovereignty that Taiwanese people have fought so hard for will hallow out into bubbles. Forecast to this point indicates that an extremely severe and bloody new February 28th Massacre will occur. If A-Bien’s administration cannot seize the advantage of his presidency and endure the suppression of China party, then the future of Taiwan will be unbearable to behold. A-Bien go go go! The Taiwanese people already possess the fearless-of-death determination.

為守護台灣自焚殉道的劉柏煙---taiwan gods


送別劉柏煙 各地民眾湧至

〔記者陳鳳麗/南投報導〕為守護台灣自焚殉道的劉柏煙昨舉行告別式,來自全台各地認同台灣精神的團體及個人都來送劉老先生最後一程,他生前最關心的雲林縣長蘇治芬及野草莓學生代表,在他靈前致哀,蘇治芬更跪地痛哭失聲,令人動容。

台 灣北社、中社、台灣團結聯盟等一早就到場,民進黨立委翁金珠、田秋堇、蔡煌瑯等,及總統府副秘書長賴峰偉也來致哀。此外,還有許多遠從台北縣、台中縣、基 隆市、彰化縣自動前來的民眾,並有紐西蘭在台人士到場致祭,他們臉上盡是不捨和哀傷的神情。治喪總幹事前立委何敏豪說:「劉老師愛熱鬧,看到這麼多人來, 相信一定很開心!」

劉老先生自焚前口口聲聲要救蘇治芬,並在點火前表明「靈魂會保護野草莓學生」,昨日蘇治芬和野草莓學生代表都來了。蘇治芬一走進會場就淚流滿面,率雲林縣府團隊致祭時,更情緒激動地跪倒在劉老先生的靈前痛哭失聲,家屬急忙扶她起來後,她再度跪在家屬面前,泣不成聲。

司儀在野草莓學生代表致祭時透露,劉老先生過世後,家屬一直招不到魂,後來在追思會後赴自由廣場,巧遇劉老先生自焚前交談的人,才知其遺願為保護廣場上的學生,也才了解為何招不到父親亡魂。

野草莓學生代表表示,盼劉老先生的犧牲能讓政府當局知道,誰才是愛國的人,不要再有台灣人民被犧牲。

前南投縣長林宗男發表追思心聲,他提及劉老先生犧牲自己的事時數度哽咽,眼眶泛淚。

台 灣中社社長戴正德講述「劉老師生命意義」時指出,劉柏煙是為痛心陳雲林來台期間國旗被警察折斷,國格遭貶抑,為了守護台灣才會自焚;一早行經中興新村時, 街道上插了很多國旗,這樣的畫面對照當時劉老先生的心情,讓人有一種錯亂的感覺。戴正德說,劉老先生用生命示範了「台灣精神」,他告訴台灣人,願意犧牲自 己,堅持為理想打拚,為生存價值努力,這就是正港的台灣精神。

劉老先生的二女兒劉月桂代表披讀哀章和致謝詞時,提到父親死後她才知「老人家最愛的不是兒女,而是台灣這塊土地」,會場內許多人更是泣不成聲。

馬英九涉嫌偽造文書冒充律師 觸犯多國法律

我在華爾街柯爾迪茲律師事務所 (Cole & Deitz) 專任實習律師,承辦公司法、海商法及銀行法案件。

馬英九先生在二月二十四日總統大選辯論會上公開宣稱,當初為了回台灣服務只好忍痛放棄美國紐約律師事務所非常優渥的工作。想來馬先生即使過了近三十年還是 對他的美國經歷萬分自豪,畢竟這段經歷正是他縱橫台灣政壇的最大本錢。然而實際情形真的如馬先生自己宣稱的那麼美好嗎?還是已經涉及嚴重的造假行為,觸犯 包括美國和台灣在內的多國法律?

美國律師登錄名冊「查無此人」

一 個極其詭異的事實是,在辯論會及無數傳記中一再宣稱自己放棄美國律師事務所高薪厚祿的馬先生,卻在美國律師登錄名冊上「查無此人」。換言之,馬先生終其一 生不曾成功考取美國律師執照。事實上,資料顯示馬先生留美期間多次參加紐約州律師考試,結果一再落榜。(註﹕美國各州獨立舉辦律師考試,在紐約做律師須先 通過紐約律師考試。) 當然,考不上律師的馬先生硬要說自己忍痛放棄律師事務所的高薪厚祿,那是他個人的言論自由,也是對全台灣,乃至全世界千千萬萬法律系學子一個非常重要的 「啟發」。但如果馬先生不單單嘴巴「自High」,而是實際犯下冒充律師和偽造文書等刑事罪行,那就變成非常嚴肅的法律問題,決不能等閒視之。更何況多年 來遭馬先生「詐欺」的不止台灣人民,還有國際組織、各國政府。

現在﹐就請父老鄉親備妥相機、攝錄影機、或其它存證工具,與我一同開始這場驚險刺激的搜證之旅。罪證有可能短時間內便紛紛被湮滅或篡改,所以動作要快!

中文履歷造假﹕無中生有的「美國實習律師」

作 為暖身﹐請大家首先漫步到馬蕭競選總部,坐下來泡杯熱茶,隨手瀏覽馬總統侯選人的官方履歷。翻開官方履歷第二頁(http://www.ma19.net /taxonomy/term/8?page=1)﹐然後拍照存檔。見到最底下的「柯爾迪茲律師事務所實習律師 1981/1/1~1981/12/31」沒有? 當然有啊,這算什麼罪證,馬先生難道不是一路走來,始終如一地自稱「美國實習律師」?

俗 話說內行人看門道。在台灣「實習律師」代表成功考取執照、接受培訓的新進律師。馬先生的詐欺行為在於他不曾考取美國律師執照,卻在自美返台後偷天換日,捏 造「美國實習律師」一職矇騙政府官方、學術機構與民間百姓,近三十年來不當獲得的有形、無形利益難以估算。事情的真相是,美國法律界從不存在「實習律師」 一職,只有「暑期實習生」(Summer Intern),供法律系學生暑期兩、三個月實習的機會,無需律師執照,工作內容簡易初級。故意將「暑期實習生」藉由「筆誤」變成「實習律師」所不法 A 到的「好康」,決不亞於將「助教」變成「教授」,「助理」變成「經理」,更何況「暑期實習生」與「實習律師」之間還有專業證照持有與否的嚴重問題。當年經 國先生在拔擢馬先生擔任總統府第一局副局長前,肯定對他的履歷問過一句「你是美國實習律師」? 其實經國先生問話的意思是「你有美國律師執照」?可想而知,馬先生答道「我是美國實習律師,但情願忍痛放棄美國律師事務所的高薪厚祿回來報效國家」便輕而 易舉地愚弄了經國先生,一如他愚弄兩千三百萬台灣人民迄今。精明如經國先生者,儘管已對下屬再三警告「萬萬不可讓持有綠卡這種腐蝕人心士氣的投機份子逍遙 自在」,卻萬萬沒料到咫尺之遙就是一個既持有美國綠卡,又冒充美國律師的超級投機份子。以後無論在政界法界學界,無中生有的「美國實習律師」便和履歷上另 一堆假冒偽劣(美國法律顧問、研究顧問等),相助馬先生過關斬將,直逼權力頂峰。

犯行有了,犯意有沒有? 看看馬先生自己填的律所任職日期就知道了。咦,怎麼會是1981一整年的時間 (1981/1/1~1981/12/31),難道又是「筆誤」?這當然是「筆誤」,而且是精心算計過的「筆誤」。馬先生總不能老老實實地填任職三個月吧 (比如說 1981/6/1~1981/8/31) ,那豈不等於昭告天下他沒考上律師,實際幹的是無需執照的「暑期實習生」(Summer Intern) ? 既然沒考上律師,又怎能對台灣法律界自稱是領有執照的「實習律師」? 開始撒一個謊,後來只能撒更多的謊來圓。圓謊不易呀!

離 開馬蕭競選總部之前,請大家順便翻到馬先生官方履歷第三頁 (http://www.ma19.net/taxonomy/term/8?page=2),然後拍照存證。看到最上面的「美國波士頓第一銀行法律顧問 1980/1/1~1981/1/2」了嗎?這裏頭尚有一段不為人知的傳奇故事,以後有機會再談。

英文履歷造假﹕欺騙國際組織及各國政府

當 初我撰寫 「揭穿馬英九偽造履歷!兼論謝長廷三大勝選謀略」一文時﹐並未直接指控馬先生的「美國實習律師」是假冒偽劣。原因是我想或許有百分之一的機會﹐馬先生真的 不是蓄意物換星移﹐把「暑期實習生」惡搞成「實習律師」。如果馬先生的英文履歷如實填寫Summer Intern﹐美國法院恐怕也就懶得受理此案。為了讓美國法院確認馬先生捏造「美國實習律師」一職必有冒充美國律師的意圖﹐且無需透過中文翻譯便可將其繩 之以法﹐我開始蒐集他的英文官方履歷。後來發現﹐馬先生果然在英文履歷上百尺竿頭更進一步﹐堂而皇之地自封「華爾街律師事務所執業律師」(Wall Street Law Firm Associate) ﹐ 任何和「實習」相關的詞彙則全告消失無蹤!

台灣 的父老鄉親可能對 Law Firm Associate 這個職稱不大熟悉。雖然Associate在非專業的領域可以代表「同僚、同事、同夥」,但在專業領域裏有其特殊、嚴格的定義。比如說,學術界的 Associate Professor 指的是「副教授」,而不是「同僚教授」。同樣地,在美國法律界待過的人都知道,Law Firm Associate 作為法律專有名詞就是「律師事務所執業律師」。美國韋伯法律專業辭典對Associate下了清楚明確的定義﹕a lawyer employed by a law firm (受僱於律師事務所的律師,詳見 (http://dictionary.reference.com/search?db=mwlaw&q=associate) 。事實上,大家如果有機會拿到美國律師的名片﹐就會發現美國律師較少自稱 Lawyer,而是廣泛地使用 Associate (律所執業律師) 或 Partner (律所合夥人) 。這一點馬先生當然清楚,因此他在英文履歷中冒用Associate職稱絕非無心之失。如果 Associate 是馬先生自美返台後捏造出來的「美國實習律師」,那麼全美國幾十萬 Associate 又算什麼?為什麼我們幾十萬堂堂正正高考及格的美國執業律師,要被你馬先生一個暑期實習生矮化成不倫不類、莫名其妙的「美國實習律師」? !不過想到三十年來被愚弄的不只我們美國律師,還包括經國先生,台灣人民,甚至世界各國政經領袖,也就覺得可笑多過可恨了。

會 見完各國領袖﹐接著請父老鄉親回到台灣行政院新聞局逛逛﹐說不定有機會撞上謝志偉局長。翻開新聞局向國際友邦友人介紹的台灣名人錄一看 (http://www.gio.gov.tw/taiwan-website/5-gp/yearbook/00who-1-lo.html)﹐馬先生 的履歷同樣是「Assc., Cole & Deitz Law Off., New York 81」。「Assc.」是 Associate 的縮寫,所以馬先生依然謊稱自己是柯爾迪茲律師事務所的執業律師。當然,被捉包以後馬先生很可能語帶哽咽地表示,第一份履歷純粹是「為國爭光」,第二份則 遭到謝志偉「嫁禍栽贓」。好好好,算你厲害,果然是「有練過」‧‧‧

那 就別怪我帶父老鄉親上台北市政府「踢館」了﹐正如馬先生所說﹐這些都是「公共空間」嘛! 大步邁進「太上市長辦公室」﹐赫然見到「太上市長」辦公桌上擺著一份英文履歷﹐龍飛鳳舞且敘述詳盡﹐應該是馬先生親筆撰寫的沒錯 (http://english.taipei.gov.tw/TCG/index.jsp?recordid=225)。這份履歷特別珍貴,應該很快會 被燒掉或篡改,所以大家知道怎麼做了吧。其中最精彩的一句莫過於﹕He then joined the Wall Street law firm Cole and Deitz as an associate. 在美國待過的人都知道「joined」的意思是「正式加入正規編制」,不會拿來形容暑期實習的學生。所以我必須誠懇地拜託馬先生﹕既然你親筆撰寫自己「正 式加入華爾街柯爾迪茲律師事務所成為執業律師」,又說自己任職 Associate 時間長達一年 (1981/1/1~1981/12/31) ,可不可以請你把美國律師執照拿出來,讓父老鄉親瞻仰一下?還是你準備和綠卡疑雲一樣,對大家說「過去有,現在已經放棄了」?

哈佛的「老鼠屎」

馬 先生接二連三出包出糗後,哈佛校譽隨之蒙羞,這次再爆馬先生涉嫌冒充律師及偽造文書,想必台灣人民對哈佛的教育品質更加搖頭了。其實我們哈佛人在社會上大 多還是安分守己,不像馬先生一路玩虛弄假、目無法紀。搜證之旅的最後一站,我想請父老鄉親參觀美國法律界五巨頭之一的盛信律師事務所 (Simpson Thacher & Bartlett) ,看看律所內一般「正常」的哈佛人是如何嚴守分際,避免誤觸法網。來來不用客氣,直接進到它的哈佛同學會客室 (http://216.105.98.11/Lawyersearch.cfm?sLawSchoolID=107) 。 看到裏面上百位哈佛校友了嗎? 其中三十幾位是 Partner (合夥人),五十幾位是 Associate (執業律師),還有十幾位是 Not Yet Admitted (尚未宣誓就任)。合夥人Partner就不用多說,個個都是驍勇善戰,落落長的豐功偉績。至於執業律師Associate五十幾個,大家任意點擊一個都 會看到律師本人的「宣誓就任獲准執業轄區」(Admissions) ,比如Associate名字排在最前的Karen E. Abravanel,她的Admissions一欄寫著New York 2004,代表她於2004年在紐約州宣誓就任律師,獲准在紐約州執業。同樣地,排在最後的Wei Yu,他的Admissions寫著New York 2006,即2006年紐約宣誓,獲准紐約執業。請問馬先生﹕你在哪裡宣誓就任律師,獲准在哪裡執業呢?

除 了合夥人Partner與執業律師Associate以外,名單末尾還有十幾個「尚未宣誓就任 Not Yet Admitted」。什麼叫「尚未宣誓就任」呢? 原來美國律師高考放榜後,金榜題名並不代表立刻變成律師,還必須接受律政機構長達數月的道德品格審查 (Moral Character Review),看看有無不良前科,審查過關才有資格在法官面前宣誓就任律師。即便你已經通過律考,只要一天沒通過道德審查,沒宣誓就任,就一律得在所有 文件材料上掛著這個不大順眼的名號 Not Yet Admitted,否則就是違法。再舉個例子讓大家了解「正常」的哈佛人面對法紀是如何誠惶誠恐﹕十幾個 Not Yet Admitted 當中,有一個來自Peru (秘魯) 的Sergio Y. Amiel先生,到哈佛唸書及通過紐約律考前早已是秘魯的執業律師,但由於尚未在紐約宣誓就任獲准執業,就只好老老實實地掛著 Not Yet Admitted,大氣也不敢吭一聲。

說到這裏,父老鄉親應該明白一個連律考都通不過的暑期實習生,謊稱執業律師罪行有多嚴重了吧。當我把馬英九先生的履歷拿給三位美國法律界的前輩看時,大家看法都是一致﹕“This is a serious crime.”
“This is a serious crime”

為 什麼美國法律界的前輩認為馬先生的行為是 serious crime 呢? 又為什麼明明已經通過律考卻尚未宣誓就任的一群哈佛人﹐還得乖乖往自己臉上貼個 Not Yet Admitted 的大標籤呢? 那是因為在美國如果沒有正式獲准執業,卻在言語、文字、或行為上誤導別人相信自己是律師,就是犯了所謂「Falsely Holding Oneself Out as a Lawyer」(冒充律師罪),各州皆有相關刑責。由於馬先生無論在英文、中文履歷中都一再宣稱自己是紐約律師事務所的律師,又說當年忍痛放棄紐約律師事 務所的高薪厚祿﹐如果他拿不出紐約律師執照,將受到紐約州法以下的制裁:

  • 美國紐約州 無照執業罪〈http://www.op.nysed.gov/subart4.htm

    Anyone not authorized to practice under this title who practices or offers to practice or holds himself out as being able to practice in any profession in which a license is a prerequisite to the practice of the acts…shall be guilty of a class E felony.

    大意 是說,一個在某專業領域沒有執照的人,如果從事,或「裝成」可以從事該專業的業務,而從事該專業業務又必須先持有執照 (如律師、醫師),那麼此人便觸犯E級刑事重罪 (四年以下有期徒刑)。特別要強調的是,美國法律普遍使用「裝成X師」(Holding Oneself Out) ,而不是「自稱X師」(Calling Oneself) 的語彙來形容這類犯罪的慣用手法。所以退一萬步講,即便馬先生從來不曾自稱是「美國實習律師」或「正式加入律師事務所成為執業律師」(更別說他已經白紙黑 字寫下了),只要他在言語或行為上誤導別人相信自己是律師,就已經觸犯法條。換言之,光憑馬先生在辯論會及無數傳記中一再宣稱自己「忍痛放棄美國律師事務 所的高薪厚祿」,便足以讓法官認定有冒充律師之嫌。


  • 美國紐約州 冒用專業職稱罪〈http://www.op.nysed.gov/subart4.htm

    Anyone not authorized to use a professional title regulated by this title, and who uses such professional title, shall be guilty of a class A misdemeanor.

    單單將「暑期實習生」藉由「筆誤」變成「實習律師」﹐或「Summer Intern」變成「Associate」﹐便構成冒用專業職稱罪 (一年以下有期徒刑) 。

    其 實美國政府已經注意到馬英九先生這類渾水摸魚、濫竽充數的南郭先生。由於不少大學(包括哈佛) 的入學申請程序經常對各國權貴子弟「放水」,美國政府只能在專業證照考試上嚴加把關,以確保公眾利益不受損害。這份「紐約州教育部及司法部聯手打擊無照執 業的報告」明確表示,今後加強掃除的對象之一,就是攻讀某專業但最終無法通過該專業的證照考試,卻又出來行騙的「江湖郎中」(Imposters)。


江湖郎中 防不勝防

「江 湖郎中」在世界任何角落都是非法,不管是美國,台灣,還是舉辦世經論壇東亞峰會的新加坡。美國紐約司法部門已經著手調查馬先生的相關罪行,按冒充律師與無 照執業處理。新加坡屬英美法系,刑責應與美國相去不遠﹐至於要不要「鞭刑」我不確定。而台灣檢調單位如果不以偽造文書、登載不實、甚至詐欺罪將馬先生起 訴,便有瀆職之嫌。三十年來受騙上當的政府部門、大學機構、人民百姓、何止千千萬萬?

可能會有部分民眾覺 得舉發馬英九先生冒充律師是選舉「奧步」啦,他有沒有執照干我何事? 沒錯,的確有些事情到了選舉期間才會被攤在陽光下檢驗,但也有些問題關乎全國人民生命財產安全的大是大非,是超越藍綠,超越族群,超越國界,放諸四海而皆 準的。不管你自認是藍色,綠色,還是中間,你願意將生命、財產、或其它個人權益事項託付給一個「無照郎中」嗎?各國政府之所以舉辦各樣的證照考試,就是為 了確保執業人員具備合格的專業水平,足以讓民眾信賴託付。試想如果自己上了手術台後,為了舒解緊張氣氛因而半開玩笑地問:這位帥哥,你有醫師執照嗎? 結果對方竟然答曰﹕我曾是台大實習醫師。再問一次有無行醫執照,答曰﹕我忍痛放棄台大醫院的高薪厚祿到你們這裏來「LONG STAY」。麻醉針打下去,意識模糊前掙扎地再問最後一次,答曰﹕你放心,我到哈佛唸過書,開刀從沒死過人,英文更是讚‧‧‧

如今台灣詐騙集團猖獗,冒用律師、檢察官、法官的例子屢見不鮮,但這些人同樣也是利用假職稱假經歷來騙取信任獲取暴利,本質上與馬先生的行為又有何不同?

人間天堂?

以 我對馬英九先生行為模式的長期觀察,我認為如果他被一群記者圍住質疑「美國實習律師」造假,退無可退的情況下,應該會回答﹕我在美國做的是「實習律師」, 而且在所有履歷上也說自己是「美國實習律師」,因為在美國做「實習律師」無需律師執照,所以沒律師執照也沒什麼大不了云云。

其 實我很嚮往馬先生眼中的美利堅合眾國,因為他真的把這個國家當成「人間天堂」了。綠卡有沒有效自己可以決定,做律師要不要執照自己也可以決定。如果馬先生 的邏輯可以成立,費時費力前往美國大使館宣誓放棄綠卡的人(包括周錫瑋縣長) 豈不成了冤大頭?此外,全台灣那麼多法律系同學拼死拼活流淚流汗,花大把時間金錢上國考補習班幹什麼?只要買張機票到美國待上幾個月,回台之後誰都能吹自 己是美國實習律師兼實習法官,反正一切都不需執照有誰知道你在美國刷盤子還是當律師法官?

蔣家第四代的友柏先生嚴辭批評馬先生這班權貴子弟留學美國,卻沒把民主觀念帶回台灣。在我看來﹐豈止民主觀念沒帶回來,法治觀念更沒帶回來,「人間天堂」倒是不折不扣帶回來了。所以真綠卡假律師的馬先生才能平步青雲扶搖直上,轉眼之間進窺總統大位啊!

失火的天堂!

記 得有本瓊瑤小說叫「失火的天堂」。馬先生的「人間天堂」雖好,但如果失火怎麼辦? 他一再宣示當選總統後,必定承認中國學歷,其實等於間接對中國開放台灣的證照考試。國民黨那麼多人整天往中國跑,馬先生絕對清楚中國假學歷假證照充斥的情 況,已經到了路邊隨處可見噴漆廣告的地步。沒去過中國的只要利用 Google 的搜尋引擎輸入「辦證」、「中國」 等關鍵字,便可看到大量的相關報導。去過中國的就知道各大學的校門口一堆「辦證人員」,動不動就挨過來說﹕辦證嗎? 北大、清華、復旦、交大任你挑;律師、醫師、教師、會計師應有盡有‧‧‧匪夷所思的是,不少大學的行政部門竟被那些非法辦證人員「打通任督二脈」,以至於 產生無數「假」的「真學歷」,也就是說你去電查詢時他們會告訴你「確有此人」!幸虧美國是個真正的法治大國,而不是什麼「人間天堂」,所以馬先生迄今未能 「打通任督二脈」,否則我這篇文章就甭寫了。

在這種惡劣的情況下承認中國學歷,就無法避免假學歷大舉入侵 台灣。以馬先生冒充美國律師的例子來看,查證他一人的假履歷就耗去我數月功夫,未來如果千千萬萬中國假學歷假證照蜂擁而至,台灣政府一年又能查緝多少?又 要花費多少行政司法資源來圍堵阻截?與此同時,企業與民眾遭假證件詐欺而蒙受的損失又該誰來承擔?馬先生自己謊稱美國律師多年,嘗到無窮無盡的甜頭,但也 不該枉顧台灣人民權益,強迫大家接受中國的「黑心產品」。

另一方面,如果台灣政府 (包含執政與在野) 對馬英九先生假造履歷、冒充律師的嚴重罪行視而不見,也無異於變相鼓勵台灣成為「失火的天堂」,成為「無照郎中」的樂園!不用等到開放中國學歷證照,以後 民眾生病求診隨時就會撞到「英國實習醫師」,遇上糾紛就可能求助於「美國實習律師」,財務管理委託「加拿大實習會計師」,小孩教育交給「日本實習教 師」‧‧‧拿不出任何證件無所謂,「查無此人」也無所謂,反正大家都去外國「混」過,又「忍痛放棄高薪厚祿」回台服務,何必為難人家?

寫在最後
還 記得有部得過奧斯卡金像獎的電影叫「美麗人生」。主人公在納粹集中營裏無論遭遇任何惡劣的環境,總能以正面、光明、幽默的態度去詮釋周遭的一切。其實馬英 九先生面對人生重大挫折的態度,又何嘗不是一種值得效法的人生境界呢。怎麼也考不上美國律師,卻可以大無畏地對全國人民聲稱「忍痛放棄美國律師事務所的高 薪厚祿」。最近一位好友在單戀苦纏對方五年後,終於被人家嚴辭峻拒兼威脅報警,我也極力勸他「忍痛放棄這段海枯石爛、地老天荒、至死不渝的偉大愛情」。至 於我自己,其實幾個月前美國總統初選開打時,我就很想去參一腳。大家都公認論口才論智謀我怎會輸給歐巴馬、希拉蕊之流?誰知道美國選委會死也不肯讓我報 名,毫不留情地把我掃地出門。無所謂無所謂,此乃非戰之罪﹐真要出馬,他們哪裏是我的對手。如今我逢人就說﹕為了以後回台灣服務,只好「忍痛放棄2008 年美國總統寶座」。Oh﹐Life Is Beautiful!

Ma sticks to ROC Constitution’s writ
 

‘FREE REGION’: The president said that adhering to the 1991 interpretation of cross-strait relations had contributed to peace and stability in the Taiwan Strait

President Ma Ying-jeou (馬英九) said yesterday that the Republic of China (ROC) was an independent sovereignty whose territory covered China, as dictated by the ROC Constitution.

Ma made the remarks while addressing senior government officials attending a workshop on mainland affairs in Taipei yesterday morning.

Ma said he had not invented the notion of cross-strait relations as it was clearly defined in the ROC Constitution. While both sides of the Strait refused to recognize each other between 1949 and 1991, the status of the two sides changed in 1991 when the ROC Constitution was first amended, he said. It was further validated by the Act Governing Relations between the Peoples of the Taiwan Area and the Mainland Area (台灣地區與大陸地區人民關係條例) in 1992, he said.

“The concept was introduced 17 years ago during Lee Teng-hui’s (李登輝) presidency and the former Democratic Progressive Party (DPP) administration did not change it at all during its eight years in power,” Ma said.

Ma said such a notion was an important element keeping the Taiwan Strait stable, adding that a majority of Taiwanese was in favor of maintaining the so-called “status quo.”

I am doing exactly what the people are hoping for, he said.

Ma said he did not denigrate Taiwan’s sovereignty by upholding such a concept, as the constitutional amendment clearly refers to Taiwan as the “free region” and China as the “mainland region.”

“The free region and the mainland area are part of the territory of the Republic of China,” he said. “The Republic of China is a sovereign country, whose sovereignty has been independent since it was founded in 1912.”

Countries that split after World War II have similar constitutions, including Germany and South Korea, he said.

While both sides refused to recognize each other between 1949 and 1991, Ma said, they have gradually moved toward “mutually not denying each other” since 1992.

Commenting on the cross-strait direct transportation links, Ma said his definition of a “cross-strait route” was that it was “a special route.”

“It is not a black-or-white answer,” he said. “By doing so, we put aside differences and create a win-win situation.”

Ma also defended his administration’s efforts to bypass an international treaty on endangered species to import two giant pandas from China

Despite a claim by the Convention on International Trade in Endangered Species (CITES) that the import was a “domestic trade,” Ma said “it was quite clear and simple” that it was not a “domestic trade,” as the two animals had to go through customs.

Emphasizing that China is a threat as well as an opportunity, Ma said his administration had a mandate to minimize the threat and maximize the opportunities.

The international community should welcome the thawing relations across the Strait and should appreciate that Taiwan has become a “peacemaker” rather than a “troublemaker,” Ma said.

While some have criticized him for tilting toward Beijing, Ma said he only leaned toward Taiwan and that he had never done anything that compromised the sovereignty, national interest or honor of the country.

“There is no need to worry that I will sell out Taiwan, because [for me] Taiwan is always the focus and the people’s interest always comes first,” he said.

 


 

 


 

Police not above the law

Over the past few months I have witnessed a number of incidents in which police have acted inappropriately toward peaceful protesters. Some of these incidents occurred during the time of Chinese envoy Chen Yunlin’s (陳雲林) visit to Taiwan, but there have been others, both before and after.

In all these cases, people were protesting peacefully. They merely wanted to express their opinions and be heard by the government. They were acting in a reasonable manner and had no intention of causing unnecessary disturbance to the general public.

Taiwan needs to put in place clear mechanisms for investigating police misconduct. Police are responsible for upholding the law, but they should never be above the law. There also needs to be an independent commission established to thoroughly investigate the incidents that happened during Chen’s visit.

I know the police do a difficult job and work very long hours. However, I would like to humbly offer some advice to them.

First, they should make more of an effort to communicate with protesters. Engaging in dialogue and negotiation can resolve the vast majority of conflicts. It also allows both sides to develop greater mutual respect toward each other.

Second, they must at all times respect human rights and the law. The Universal Declaration of Human Rights and chapter two of the Constitution provide the basic principles on which laws are founded. The laws provide a further framework for these rights. It is the police force’s job to enforce the law.

However, human rights should always be used as the first principle.

Beijing is controlling our destiny

The two-day Cross-Strait Economic, Trade and Cultural Forum (國共經貿論壇) held between the Chinese Communist Party (CCP) and the Chinese Nationalist Party (KMT) ended on Dec. 21 in Shanghai.

As expected, during the closing ceremony, China’s Taiwan Affairs Office Chairman Wang Yi (王毅) announced a series of measures to help Taiwan. These measures included extra financing of up to 130 billion yuan (US$19 billion) for Taiwanese businesspeople investing in China from the Industrial and Commercial Bank of China (ICBC, 中國工商銀行) and other banks, and plans to purchase US$2 billion worth of Taiwanese manufactured flat screen panels.

He also called for Taiwanese businesses to take an active part in construction projects aimed at increasing domestic demand in China, assisting Taiwanese-invested businesses in China to transform and upgrade, encouraging and supporting Taiwanese-invested businesses to carry out innovation, establish farms in China for Taiwanese farmers, increasing the amount of Taiwanese fresh produce sold in China and allowing Taiwanese citizens who meet certain criteria to practice law in China.

On the surface, these measures may seem extremely useful for getting Taiwan out of its current economic woes. However, when viewed rationally, it is easy to see that these measures are nothing but sugar-coated poison pills aimed at gradually and systematically ruining Taiwan, both politically and economically.

Firstly, during the cross-strait forum, China has tried to put itself across as the motherland coming to the rescue of struggling Taiwan. By doing so, it is trying to turn Taiwan into a new Hong Kong or Macau, with the aim of colonizing it economically and politically. Before their respective handovers, both Hong Kong and Macau had flourishing economies and their people enjoyed political freedom, especially in Hong Kong, a primary financial center in Asia. However, after the return of Hong Kong and Macau to China, both their economies fell to a point where they were forced to rely on China’s help.

During the 1997 Asian economic crisis, Hong Kong relied on help from China to escape economic collapse. This, however, also made it impossible for Hong Kong to escape from China’s control. After the handover, Hong Kong’s economy took a turn for the worse and hit rock bottom in 2003 when the territory was gripped by the SARS epidemic. At this time, China managed to create a false sense of prosperity in Hong Kong by measures to boost the economy that included allowing Chinese tourists to travel freely within Hong Kong and ratifying economic agreements that brought the territory closer to China, such as the Closer Economic Partnership Arrangement.

The false sense of prosperity created in Hong Kong by China means that although the economy may prosper, that prosperity is inextricably linked to China and the decisions its leaders make. In the event that China does not want to help Hong Kong, the territory’s economy would be finished.

Macau’s situation is exactly the same. Now, faced with the financial crisis, although China is having a tough time helping itself, it still is not too much trouble for Beijing to give some assistance to Hong Kong and Macau, since they are relatively small places. In addition, this “assistance” once again confirms China’s ruling status over Hong Kong and Macau.

By saying that they will give assistance to Taiwan, China is basically viewing Taiwan in the same way as Hong Kong and Macau, which means that China wants to use these methods to turn Taiwan into another Hong Kong or Macau, for which Beijing views the KMT-CCP forum as the best platform.

Secondly, the Ma administration sent five government officials to China to take part in the forum, which was against the Act Governing Entry Permission to Mainland China for Government Employees and Persons with Special Status in the Taiwan Area (台灣地區公務員及特定身分人員進入大陸地區許可辦法), which states that political officials can only go to China to attend international conferences.

In essence, this was the same as Ma taking back what he previously said about the KMT-CCP forum being a secondary channel for handling cross-strait issues and recognizing that the forum Chinese President Hu Jintao (胡錦濤) is trying so hard to promote is in fact the primary channel for deciding cross-strait policy. In other words, in the future, the government’s China policies will no longer be controlled by the Presidential Office, the Cabinet and the legislature. Decisions will first be made by the KMT-CCP forum and then handed over to the Ma administration for implementation.

This will mean that it is the KMT and the CCP, or to be more precise, the CCP alone that will decide the future of Taiwan and its people. In this scenario, all the Presidential Office, Cabinet and legislature can do is wait for orders from above.

In the future, the Ma administration is going to loosen restrictions and allow even more of Taiwan’s political officials to go to China. By that time, in addition to Taiwan’s economy being totally controlled by China, we will also have no way of protecting the confidentiality of Taiwan’s national defense, military and diplomatic information, and this will put Taiwan’s national security in severe danger.

We should take a good look at Hong Kong. At least Hong Kong was able to gain some economic benefit from its return to China. However, all the government’s kowtowing has gained nothing for Taiwan. A mere 10 percent of the originally promised 3,000 Chinese tourists that were supposed to visit Taiwan each day via the direct charter flights have come to Taiwan and the majority of passengers on weekend charter flights are Taiwanese businesspeople.

An inordinate proportion of the passengers on cross-strait flights are Taiwanese people going to China rather than Chinese tourists coming here. After the official three-links are opened and Taiwan becomes more closely linked with China’s coastal regions, industry will be further undermined and more talent and funds will flow out of Taiwan.

The Taiwanese public must make efforts at self-recovery for the economy to bounce back. We need to improve Taiwan’s domestic investment environment, offer discounts to local businesses on rent, water and electricity and start to improve the fundamentals of Taiwan’s economy. The investment environment in China is worsening by the day and this can be used to start attracting Taiwanese businesspeople back to Taiwan. These are fundamental ways to reinstill life into Taiwan’s economy.

Unfortunately, the government is taking an extreme pro-China stance on issues like national identity, ideology, economics, politics and diplomacy.

China is the Ma administration’s only savior and worshiping China is all the Ma government knows. China has used the Cross-Strait Economic, Trade and Cultural Forum to issue orders to the Ma administration. In doing so, it has effectively trampled on Ma and his government, the legislature and the Taiwanese public.

This is all the result of Ma’s own wrongdoing.
