我到流亡中國高檢署被偵訊的經過
二零零九年十月二十七日上午九十四十分，我準時到達台北博愛路高等法院檢察署，門口已經擠滿來自各路記者，向支持者打過招呼後，開始接受媒體訪問，九時五十五分在法警引導下，進入偵訊室，位置在一樓，隔開鐵門，有點像我在四川被關入看守所一般的情境，進入偵訊室，原來高等法院檢察官已經在等著偵訊，檢方命令法警幫我準備椅子，坐定後開始偵訊：
檢方：你的出生年月日、地址和電話。
林：˙˙˙˙˙˙˙˙
林：請問今天我是什麼身分？
檢方：你今天是外患罪被告也是證人，你可以拒絕作證，依法保持緘默。
林：我願意做證。請問是何人提告？
檢方：中國國民黨立法院黨團檢舉並剪報。
檢方拿出證人切結書，林看過後，簽字。
檢方：你是什麼理由控告美國？
林：二零零六年十月二十四日，在美國華盛頓聯邦地方法庭，提出控告美國白宮、國務院以及國防部，是根據舊金山和平條約第二b條、第四b條與第二十三條，要求美國釐清與台灣之關係，依照國際戰爭法與美國對外戰爭慣例，發台灣人美國國民非公民護照。
檢方：請你簡述上述條約內容。
林：第二b條：日本放棄台灣領土權（不是台灣主權），因為條約之right 、title、 claim都沒有加s。第四b條：日本人民（含台灣人民）與財產遵從美國軍事政府分配與支配。第二十三條：美國是台灣地區主要佔領權國。
檢方：你有沒有意圖將台灣交給美國？
林：台灣從來不會是美國第五十一州，因為與法不合，不可能發生。我所追求的是：讓台灣回到理史原點，本土台灣人才有資格按照聯合國憲章第七十三條自治，二戰後，美國是台灣唯一征服者，依照戰爭法有佔領權。提醒美國戰後對台灣有義務要履行。本土台灣人有權領取美國國民非公民護照。
檢方：你有無替陳水扁控告美國？
林：所有與陳水扁前總統律師李維之書信往來，都是由我書寫後，交李維律師變成法律文字，然後向美國軍事上訴法庭提出，陳前總統不是完全瞭解內容，不過，九月二十三日，我將已經完成之訴訟狀交扁辦轉交陳前總統。兩個訴訟文件都我自己與律師坎普和律師李維，直接以電子郵件討論後定稿，與其他人都沒有關聯，陳前總統也一樣，他尊重我的研究。
檢方：你如何知道訴狀有交給陳水扁？
林：當天蘋果日報剛好有照片照出看所守人員拿著該訴訟狀。
檢方：陳前總統有付錢給美國律師嗎？
林：沒有。
檢方：那是誰付錢？
林：在美國的本土台灣人，我們的組織福爾摩沙法裡建國會和台灣民權訴訟組織成員付的，與陳前總統無關。
檢方：姚嘉文說陳前總統被你騙與利用了？
林：姚老先生或許年紀太大，根本不知自己在說什麼？如庭上所看到的「李維律師與客戶協議書」，是八月二十五日陳前總統所簽，上面還有台北看守所檢查的紅色標記，可以證明是陳前總統本人的意思。
林志昇遞出兩個控美案文書給檢方，檢方似乎不了解控美案有「林志昇控美案」與「陳水扁控美案」，口中喃喃自語半天，翻閱六法全書後，再問：
檢方：陳前總統不是要去做證嗎？
林：林志昇控美案在美最高法院審理時，我要求陳前總統以中華民國前總統身分出庭作證：「美國確實有在台灣行使主要佔領權國管轄權，運作主權」，他要作證的是這個，因為，二零零六年六月二十六日，AIT處長楊書棣曾經赴總統府作三項「訓示」一、台灣不是中華人民共和國之一部分。二、台灣人不可以公投、不可以加入聯合國。三、直到今天美國堅持台灣地位未定。陳前總統要作證的是這個部份。
檢方：那陳水扁控美部分又是什麼？
林：中華民國內部的媒體跟名嘴都是胡說的，根本不了解陳前總統的控告內容瞎掰，請問檢察官知道陳前總統在告什麼嗎？
檢方：你說說看。
林：簡單說，就是陳水扁前總統要求：「移轉司法管轄權」。我來舉例：一九四五年麥克阿瑟佔領日本時，如果麥帥犯法，請問是交日本審判或美軍事政府審判？答案當然是交美國。今天，陳前總統是延續麥帥一九四五年一般命令第一號來台，當了美軍事政府代理管轄台灣的行政官，如果有犯罪嫌疑，不會是馬先生的政府審判，應該是交由美國審判才對。今天，我們依法論法，一個學術上的探討，加上兩個控美案，竟然能夠讓中國國民黨向高等法院以政治問題提出訴訟。
林：我可以請教一個問題嗎？
檢方：請說。
林：報載，昨天高檢署檢察官加入國際檢察官協會是以「Chinese Taipei」名稱加入，你可知道「Chinese Taipei」就是Chinese exile government in Taipei流亡中國政府在台北的簡稱，高檢署自己都不承認中華民國，都自己說是流亡政府的高檢署，怎麼能夠以外患罪來控告我和陳前總統？
檢察官迴避不談。
檢方：美方或在台協會有沒有人與你接觸？
林：美方是被告，我是原告。如果雙方見面沒有律師在場，控美案會被取消，我不會那麼傻，製造機會給美方。
檢方：你有沒有去美國？
林：從二零零四年以後，我已經相信自己不是中華民國國籍，我沒有中華民國護照，也沒有第三國護照，我不會去美國，只會透過律師控告美國，這兩個控美案不會停止，現在還在持續中，陳前總統沒有撤銷律師的委託書。

前總統陳水扁向美國遞狀，稱自己是「美國軍政府在台代理人」，遭控告疑涉外患罪，台灣高檢署廿七日以證人傳喚「福爾摩沙法理建國會」執行長林志昇。林志昇說，他是藉控美案來釐清台灣主權地位，他證稱陳水扁對控美案從頭到尾都知情，藉此反駁扁辦日前指稱扁被他「利用」的說法。
林志昇當庭提出控美案的英文訴狀，及他的兩本相關著作給檢方參考，檢方將把林志昇的英文訴狀，交由調查局翻譯中文，以了解控美案訴狀內容後，再擇期訊問陳水扁。
庭訊後，林志昇向媒體表示，扁對控美案過程完全知情，並非如前考試院長姚嘉文、扁辦所指稱扁是被他「利用」。
林志昇還向媒體爆料說他前幾天請人與陳水扁見面，扁還要他「加油」，可見姚嘉文及扁辦所說「利用」一事，完全是誤會。

Taipei Times - archives: "Taiwan should have nothing to fear from screening a controversial documentary on exiled Uighur activist Rebiya Kadeer, the film's producer said yesterday in Taipei, adding that it would demonstrate that Taiwan’s respect for freedom of speech and human rights was “not negotiable.”
John Lewis, producer of The 10 Conditions of Love — a 53-minute documentary on Kadeer and her fight for improved human rights in East Turkistan, or Xinjiang — said the film did not criticize the Chinese people, but rather focused on the course of action taken by Beijing to restrict freedom of speech in other countries.
The Chinese government condemned the film and its subject, branding Kadeer a “terrorist” and a “separatist.”"

The process is not irreversible but the sentiments of those of mainland origin in the governing Nationalist Party, along with the self-interest of business groups and a widespread sense of economic vulnerability are all pushing the island toward accommodation with Beijing. The trend could mean an erosion in the support Taiwan gets, albeit erratically, from the United States and Japan. The most striking evidence of a desire to please Beijing — at the expense of the liberal values which have gained Taiwan much praise in recent years — was the denial of entry to the exiled Uighur leader Rebiya Kadeer. This was done in the name of “national interest,” apparently linked to the finalization, expected soon, of a memorandum of understanding on cross-strait financial links. For sure, the memorandum would be a major advance, enabling banks in particular to escape the confines of Taiwan, with its low growth and surplus savings, for the fast-growing mainland. And it would bring more mainland capital to local stocks and property. But the government of President Ma Ying-jeou may have forgotten that Taiwan’s national interest as an independent state, albeit one that may one day merge with the mainland, sometimes requires sacrifices. The degree of autonomy that Rebiya Kadeer has been seeking for Uighurs is a fraction of that enjoyed by Taiwan or even Hong Kong. There is real benefit in increasing cross-straits financial links. Banks have much to gain by being able to service clients in Taiwan with business on the mainland. Cross-straits links may attract service industries to Taiwan that would otherwise go to Hong Kong. Mainland tourism is also an unqualified plus. But Taiwan seems to be talking itself into believing that it is even more dependent on the mainland than need be the case. The island would be a more attractive place for foreign business if it removed the many restrictions that exist to protect local businesses, or stem simply from bureaucracy and outdated rules. Tax issues also tend to keep business offshore while not preventing a huge outflow of capital. The Ma government has made progress on these issues, but they get scant attention compared to cross-straits ones. It is easy to blame a lackluster economy on being unable to take full advantage of the mainland. But in reality, Taiwan is a mature economy with minimal growth in its work force. Like Japan, its problems lie with an inefficient domestic services sector, not with an inventive export-manufacturing one. Dependence on China is often overstated. While 40 percent of Taiwan’s exports go there, more than half are components for globally traded items like laptops and cellphones made by Taiwanese companies and then re-exported from China. The dependence is self-imposed for profit reasons, which may be shifting as mainland costs rise. There are alternatives. Worrying too for friends of Taiwan’s liberal democracy is the vengeance being meted out to the opposition by powerful supporters of the governing Nationalist Party, or KMT. Former president Chen Shui-bian was found guilty of corruption and his conduct has left the opposition Democratic Progressive Party demoralized and frustrated. But given the pervasiveness of money politics and the past reputation of the Nationalists for corruption, the life sentence for Chen is extreme. Now, in the name of fighting corruption, there is talk of a witch-hunt against other members of the Chen administration. To some this smacks of an attempt by pro-unification elements to please Beijing by demonizing Chen, who supported independence and who suffered much in the cause of breaking the KMT’s authoritarian hold on power. None of this is likely to help Taiwan’s relations with its main supporter, the United States. Chen upset a natural ally in George W. Bush by needlessly provoking Beijing in an attempt to score political points at home. Now the KMT seems to have gone to the other extreme. Taiwan has long disappointed Washington with unwillingness to spend money on arms. Now it may sense a lack of willingness to pay an economic price for the principles of independence and liberalism it claims to stand for. President Ma remains well-regarded abroad, but his grip on the KMT is uncertain. Taiwan lacks a strategic view of itself and how to balance relations with the Chinese mainland, the United States and the global economy with liberal democracy and de facto independence. 分享：    | |

"1、您是第一位民進黨出身的駐美代表期間，您在華府所遭受到最大的挑戰是什麼？
答：
擔任駐美代表碰到的第一個考驗，就是阿扁總統宣示要以台灣的名義加入WHO，那時候我到華府才兩個禮拜，美方反應非常激烈，極力的反對，與美方幾場的會談，氣氛很不愉快。但基於台灣的利益，我把我擔任陸委會主委時期，中國在國際上打壓台灣的實例，尤其是在國際參與方面，對台灣已經參與的國際組織都要求改名，改為「中國 台北」、「中國 台灣省」或「中華人民共和國 台灣省」，這些動作在2005年中國通過「反分裂國家法」以後，更是全面積極的去推。我把相關文件交給美方，但反應非常無力，美方往往選擇默不做聲。
2007年6月，阿扁總統進一步提出以台灣的名義加入聯合國，美方升高壓力，不僅在華府感受得到，對台北美方施壓的力道更強。美國國務院、國安會及相關智庫，都發出強烈反對的訊息。8、9間開始推「以台灣的名義加入聯合國」的公民投票，美方直接、公開的給予以批判。在一個有關國防工業的會議之上，美國國務院亞太事務副助卿柯慶生，在他的開幕致詞，用一半的時間抨擊「入聯公投」。
當時我認為不能只待在華府，因為整個氣氛及輿論都被國務院和國安會所影響，我認為必須另闢蹊徑，一定要離開華府，到各地去拜會更多的國會議員，參加各種的會議和演講，讓台灣人民有權參與任何國際組織的訊息能夠傳播出去。這一段時間我接受美國媒體的採訪高達八、九十次。其實台美關係，表面上政治關係並不好，但表面下，針對安全及經貿等議題，合作的機制是非常密切、穩固。
2、總統府發言人王郁琦曾說他們不知道中國與「世界衛生組織」（WHO）秘書處於2005年所簽訂的有關台灣參與WHO活動的「秘密備忘錄（MOU）」是否存在，請問代表這一份MOU真的存在嗎？
答：
這一份秘密MOU確實存在！2005年中國通過「反分裂國家法」發動法理戰，企圖為「以非和平手段」實現「法理統一」提供法律依據。當時台灣政府的反應非常激烈，積極到國際上去提出我們的訴求，那個時候從外國媒體得知中國與「世界衛生組織」（WHO）秘書處針對台灣參與WHO會議及活動簽署了秘密的MOU。但一直無法取得相關的文件。一直到2007年初才透過管道輾轉取得了MOU的執行細則，明白規定：台灣的醫療公衛專家如果要參加WHO所舉辦的技術會議及活動，必須要在會議五週前向WHO提出申請，並轉中國衛生部審核。同時必須以個人的身分出席，層級要在處長以下，而且會議資料一律要註明是來自「中國台灣」的專家。
我到華府後有將相關的文件交給美方，而且我在華府所召開的第一場記者會，就把相關的資料發給當地的媒體，所以中國與WHO秘書處所簽訂的秘密MOU確實是存在的。今年5月，馬政府派代表以觀察員的身分參加「世界衛生組織」的年會（WHA），相關的書信往來及程序，完全照著當時MOU所規定的執行細則，所以有學者大聲疾呼，認為不應該接受，不然就是落入中國的圈套，完全照著中國寫好的劇本演出。
3、當阿扁總統提出以台灣的名義申請加入聯合國，結果美國白宮國安會東亞事務資深主任偉德寧，公開於記者會表示：「台灣或中華民國現階段在國際社會並非一個國家」，偉德寧的發言真正的意涵是什麼？
答：
美國在外交上不承認中華民國，因此認為中華民國或台灣都不是一個國家，但美國不願意把確實的內涵說清楚，也不願把話講死。針對這個議題有兩個非常重要的文件，第一是雷根總統的「六項保證」。當年海格國務卿要與中國簽署「817公報」，雷根總統認為對台灣的衝擊太大，因此派李潔明來台灣面見蔣經國，提出美國的「六項保證」，其中的第五項：「美國並沒有改變有關台灣國家主權地位的立場。」（The United States has not altered its position regarding sovereignty over Taiwan）另一項文件就是「台灣關係法」第四條（Ｂ）（１）項規定，「凡美國法律提及或涉及外國、外國民族、外國國家、外國政府或類似實體時，此等名詞應包括台灣，此等法律亦應適用於台灣。」這兩項文件，總結來說有兩個重點：第一，美國「認知」中國「堅持台灣是中國一部分」這樣的主張，但美國不接受中華人民共和國對台灣擁有主權這樣的主張與說法。第二、美國認為台灣是實質上獨立存在的國家，但在政策上美國不予以承認。台灣的地位是事實獨立存在，但未來如何美國不願意講清楚。柯林頓時代美國的政策為，台海的議題一定要和平解決，而且要經過台灣人民的同意。而布希總統則修改為，和平解決及兩岸人民的同意，台灣人民如果不同意，基本上是擁有否決權。
這樣的政策立場於2007年2月聯合國秘書處錯誤解釋聯合國第2758號決議文，再次被凸顯。當時立法院通過「反歧視婦女公約」，然後請友邦諾魯向聯合國秘書處要求將這一份公約置放於聯合國。聯合國秘書處回函時表示，依據聯合國第2758號決議，聯合國視台灣為中華人民共和國不可分割的一部分。台灣立即將相關訊息與美方交涉，之後美國正式向聯合國秘書處提出九點的外交照會，後來照會的內容被華府的智庫所披露，其中包括：聯合國第2758號決議文，從未提及中華人民共和國對台灣擁有主權。另外，聯合國秘書處如果堅持主張台灣是中華人民共和國的一部分，美國將公開反對如此之立場。
4、之前布希總統與中國國家主席胡錦濤通電時，曾談論到「九二共識」為「一個中國、各自表述」，但對於「各自表述」是出自胡錦濤之口，或是美方的詮釋始終無法得知，真正的內幕為何？
答：
2008年4月美國總統布希與中國國家主席胡錦濤通電話，之後由美國國家安全顧問海得利轉述談話的內容，曾提及「九二共識」即指「一個中國、各自表述」，之後新華社英文版新聞稿亦包括相關的報導，但中文版就沒有「各自表述」這個部分。事後，我曾向國務院查證，但國務院的官員表示，這是由白宮與國安會所主導，國務院沒有相關的訊息。再詢問國安會則說一切依照當日的新聞稿，不願再提供任何新的訊息。
「各自表述」到底是不是胡錦濤講的，還是美方自己的詮釋，意圖使兩岸的對話能夠展開，美國官方不願意給任何的答案。但從之後情勢的發展，有沒有「各自表述」似乎已經不重要了。中國方面，除了新華社的新聞稿曾經出現過一次外，之後從來沒有再提及過。另一方面，馬政府在解釋「九二共識」，也愈來愈不去提「各自表述」，可以說全面的接受了中國所提的「一個中國原則」。未來我們可以仔細觀察，兩岸的協商依慣例都會先提在「一個中國的原則」下，或在「九二共識」的基礎上如何、如何，到時候我們就可以看馬政府會不會堅守「九二共識」指的是「一個中國、各自表述」這樣的底線，要求中國白底黑字的寫清楚，如果中國不願意，馬政府「自我欺騙」的不實說法就不攻而破。

美國在外交上不承認中華民國，因此認為中華民國或台灣都不是一個國家，但美國不願意把確實的內涵說清楚，也不願把話講死。針對這個議題有兩個非常重要的文件，第一是雷根總統的「六項保證」。當年海格國務卿要與中國簽署「817公報」，雷根總統認為對台灣的衝擊太大，因此派李潔明來台灣面見蔣經國，提出美國的「六項保證」，其中的第五項：「美國並沒有改變有關台灣國家主權地位的立場。」（The United States has not altered its position regarding sovereignty over Taiwan）另一項文件就是「台灣關係法」第四條（Ｂ）（１）項規定，「凡美國法律提及或涉及外國、外國民族、外國國家、外國政府或類似實體時，此等名詞應包括台灣，此等法律亦應適用於台灣。」這兩項文件，總結來說有兩個重點：第一，美國「認知」中國「堅持台灣是中國一部分」這樣的主張，但美國不接受中華人民共和國對台灣擁有主權這樣的主張與說法。第二、美國認為台灣是實質上獨立存在的國家，但在政策上美國不予以承認。台灣的地位是事實獨立存在，但未來如何美國不願意講清楚。柯林頓時代美國的政策為，台海的議題一定要和平解決，而且要經過台灣人民的同意。而布希總統則修改為，和平解決及兩岸人民的同意，台灣人民如果不同意，基本上是擁有否決權。
這樣的政策立場於2007年2月聯合國秘書處錯誤解釋聯合國第2758號決議文，再次被凸顯。當時立法院通過「反歧視婦女公約」，然後請友邦諾魯向聯合國秘書處要求將這一份公約置放於聯合國。聯合國秘書處回函時表示，依據聯合國第2758號決議，聯合國視台灣為中華人民共和國不可分割的一部分。台灣立即將相關訊息與美方交涉，之後美國正式向聯合國秘書處提出九點的外交照會，後來照會的內容被華府的智庫所披露，其中包括：聯合國第2758號決議文，從未提及中華人民共和國對台灣擁有主權。另外，聯合國秘書處如果堅持主張台灣是中華人民共和國的一部分，美國將公開反對如此之立場。
4、之前布希總統與中國國家主席胡錦濤通電時，曾談論到「九二共識」為「一個中國、各自表述」，但對於「各自表述」是出自胡錦濤之口，或是美方的詮釋始終無法得知，真正的內幕為何？

2008年4月美國總統布希與中國國家主席胡錦濤通電話，之後由美國國家安全顧問海得利轉述談話的內容，曾提及「九二共識」即指「一個中國、各自表述」，之後新華社英文版新聞稿亦包括相關的報導，但中文版就沒有「各自表述」這個部分。事後，我曾向國務院查證，但國務院的官員表示，這是由白宮與國安會所主導，國務院沒有相關的訊息。再詢問國安會則說一切依照當日的新聞稿，不願再提供任何新的訊息。
「各自表述」到底是不是胡錦濤講的，還是美方自己的詮釋，意圖使兩岸的對話能夠展開，美國官方不願意給任何的答案。但從之後情勢的發展，有沒有「各自表述」似乎已經不重要了。中國方面，除了新華社的新聞稿曾經出現過一次外，之後從來沒有再提及過。另一方面，馬政府在解釋「九二共識」，也愈來愈不去提「各自表述」，可以說全面的接受了中國所提的「一個中國原則」。未來我們可以仔細觀察，兩岸的協商依慣例都會先提在「一個中國的原則」下，或在「九二共識」的基礎上如何、如何，到時候我們就可以看馬政府會不會堅守「九二共識」指的是「一個中國、各自表述」這樣的底線，要求中國白底黑字的寫清楚，如果中國不願意，馬政府「自我欺騙」的不實說法就不攻而破。

三、在野的民進黨應趁勢振作強勢起來主導﹗
1. ﹝他，馬的﹞冷血畜牲為「化獨漸統，終極統一」，不顧搶救災民重建災區，卻不擇手段要簽署EACF出賣台灣的賣身契，積極加速傾向共匪（中國）。

台灣國民會議 10/1/2009
十月二十五日是「中華民國」流亡政府所訂的「台灣光復紀念日」，其實這是台灣再度淪為殖民地的日子。「台灣國民會議」的組織將聯合在十月二十四和二十五日兩天舉辦大型活動：一方面，「台灣教授協會」將邀請各方面相關議題的專家學者，舉辦兩天的「中華民國流亡台灣六十年暨戰後台灣國際處境學術研討會」；另一方面，將召開「推翻中華民國流亡體制」民眾大會及「老年革命軍」、「台灣守護隊」及「台灣紅十字會」誓師大會，並進行跨夜抗爭訓練。這是台灣民族獨立革命運動的新階段，不只是史料理論的探討，更要以組織性的行動壯大整體運動的能量。台灣國民會議將強化「台灣民族主義」的自我認同，與「中華民族主義」進行區隔。
一九四五年二次大戰後，中國黨政府奉聯軍統帥之令進駐台灣，代理盟軍接受日軍投降。到一九四九年，腐敗無能的中國黨政府被中國人民推翻，乃流亡並挾其殘兵敗將強佔台灣。控制著這個流亡政權的赤藍人以「中國法統」自居，以制度化的暴力剝奪台灣人的政治權力、掠奪台灣社會的資源並引進低劣落伍的赤藍文化來扭曲摧殘台灣文化。其目的是建立赤藍人的統治優勢，好壓迫剝削在地的台灣人。長期以來，「中華民國」是一個不被主流國際社會承認的政府，而赤藍人所持的也是「撈多少，算多少」的過客心態。因此，在「中華民國」流亡體制下，台灣沒有永續發展的規劃，台灣社會在自由、民主、人權和生態各方面無法跟上先進國家，反而，台灣的國土環境和公共建設都在赤藍人的貪瀆下危機重重，八八豪雨土石流肆虐滅村、斷橋潰堤奪取人命就是赤藍人在台灣長期作孽所造成的災難。自從馬統幫復辟之後，赤藍人更不惜以「出賣台灣主權」換取中共統治階級的撐腰，妄想繼續享受特權在台灣撈油水。
這個「中華民國」流亡體制是邪惡的，是破壞台灣社會的進步的，是違反台灣民族的利益的，尤其，馬統幫正加緊出賣台灣予中共，台灣人別無選擇，只有團結組織起來，勇敢推翻「中華民國」流亡體制，建立真正屬於台灣人自己的國家，才能確保台灣的永續安全和繁榮。
